These Terms and Conditions of Use ("Terms"), together with our Privacy Policy and any additional terms applicable to specific services, form a legally binding agreement ("Agreement") between you and JMD Operations, LLC ("JMD Operations," "we," "us," or "our").

By accessing, scheduling through, or using our websites, applications, or related services (collectively, the "Services"), you agree to be bound by this Agreement.

These Terms include mandatory arbitration and a class action waiver that affect your legal rights. Please review the dispute resolution section carefully.

 

1. Our Role

JMD Operations provides administrative, technical, and operational support services to healthcare providers, consultants, and related professional entities.

We do not provide medical care, do not diagnose, and do not make clinical decisions.

All medical evaluations, certifications, prescriptions, and clinical determinations are made solely by independent healthcare providers, in their professional discretion. Use of the Services does not direct, control, or interfere with a provider’s professional judgment.

You do not enter into a provider patient relationship with JMD Operations by using the Services.

 

2. Eligibility

To use the Services, you must:

• Be legally capable of entering into this Agreement

• Be located in a jurisdiction where the requested services are legally permitted

• Comply with these Terms

The Services are generally intended for adults.

Limited services involving minors may occur only where legally permitted, with documented parental or guardian consent, and with a parent or legal guardian present for the evaluation. Any such services are provided only at the sole discretion of the healthcare provider, who determines whether to proceed in accordance with applicable law and professional judgment.

Meeting eligibility requirements does not guarantee access to any particular service.

 

3. Requirements for Use

You are responsible for obtaining compatible devices, software, and internet access. Standard carrier or data charges may apply.

We may suspend or terminate access if the Services are used in an unauthorized or incompatible manner.

 

4. Privacy

Your use of the Services is subject to our Privacy Policy, which is incorporated into these Terms by reference.

 

5. Communications

By using the Services, you consent to receive communications related to scheduling, appointments, service updates, and other operational matters.

You are responsible for monitoring communications. We are not liable for losses resulting from failure to review or act on communications.

 

6. Consultative, Telehealth, and Personalized Services

Healthcare providers and consultants using the Services may provide consultative, informational, or telehealth services remotely.

You acknowledge that remote services have inherent limitations, including the absence of an in person physical examination, and that providers may not have access to all information that would otherwise be available during an in person visit.

By using the Services, you agree to provide complete and accurate information and to assume the risks associated with these limitations.

Any opinions, recommendations, or information provided through the Services are solely those of the healthcare provider or consultant and not JMD Operations. Certain services may be informational only and are not a substitute for comprehensive medical care.

You are encouraged to seek in person medical care when appropriate.

 

7. Compliance With Law and Allocation of Responsibility

You are solely responsible for ensuring that your use of the Services complies with all applicable local, state, and federal laws and regulations.

JMD Operations does not provide legal advice, does not monitor your compliance with applicable laws, and is not responsible for any use of the Services that violates applicable legal or regulatory requirements.

To the fullest extent permitted by law, JMD Operations has no responsibility or liability for consequences arising from unlawful, improper, or non compliant use of the Services.

 

8. Use Restrictions

Your use of the Services is personal and limited to their intended purpose.

You agree not to:

• Misrepresent your identity

• Use the Services in violation of any law

• Interfere with system security or functionality

• Reverse engineer or misuse the Services

• Use the Services to develop competing products

We reserve the right to suspend or terminate access at our discretion.

 

9. Payments and Fees

Fees are due at the time of purchase and are non refundable unless expressly stated otherwise.

Pricing, availability, and promotional offers may change at any time and are not guaranteed.

 

10. Third Party Payment Providers

Payments may be processed by third party providers. Their terms and privacy policies govern those transactions.

 

11. Social Media

Our social media presence is governed by the policies of the hosting platforms. You should have no expectation of privacy on those platforms.

 

12. Third Party Links

We are not responsible for third party websites or content linked through the Services.

 

13. Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND TO THE MAXIMUM EXTENT PERMITTED BY LAW.

 

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, JMD OPERATIONS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO JMD OPERATIONS IN THE TWELVE MONTHS PRECEDING THE CLAIM.

 

15. Indemnification

You agree to indemnify and hold harmless JMD Operations from claims arising from your use of the Services or violation of these Terms.

 

16. Dispute Resolution and Arbitration

Any dispute shall be resolved by binding arbitration on an individual basis. Class actions are waived.

Arbitration is governed by the Federal Arbitration Act.

You may opt out of arbitration within 30 days of first use by written notice.

 

17. Assignment

You may not assign these Terms. We may assign them in connection with a business transfer.

 

18. Severability

If any provision is unenforceable, the remaining provisions remain in effect.

 

19. Termination

We may suspend or terminate access at any time. Provisions that by their nature survive termination shall survive.

 

20. Entire Agreement

These Terms and incorporated policies constitute the entire agreement between you and JMD Operations.

 

21. SMS and Text Messaging

By providing your phone number, you consent to receive SMS or MMS messages related to appointments, service updates, and promotions.

You may opt out by replying STOP. Message and data rates may apply.
